Spousal Maintenance

The liability to pay spousal maintenance arises as soon as a person marries and the duration of the marriage is not relevant. The law provides a right to be paid spousal maintenance if it can be shown that the other party cannot maintain themselves and the other party has capacity to maintain that person.

The court would need to be convinced that a person cannot support themselves.
