This is where one parent wishes to move to another town or suburb with the children. Both parties need to consent to this and if consent is not obtained the court may require that the parent who has relocated return with the child.
If parties cannot reach an agreement with respect to relocation, an application can be made to the court to allow relocation. The court will look at what is in the best interests of the child, the needs of the non resident parent and interests of the resident parent in coming to a decision.
