Financial Agreements Pre/During/After Marriage

Financial agreements are contracts between parties and can be entered into before, during (but before separation), after separation and after divorce.

Changes in the law have allowed these agreements to act as a substitute to personal property rights under the Family Law Act.

They do not have to be approved or registered in the court but it is important that independent legal advice is obtained and proof of this is evident in the agreement.

Agreements usually are in relation to property division but can include agreements in relation to maintenance and child support.
