Abduction of Children

Where there is a residence order in force a person cannot remove the child from the care of the person, refuse or fail to deliver or return the child to a person or interfere with the exercise of performance of any of the powers, duties and responsibilities that a person has under the residence order.

The court has the powers to assist in finding the child/children by compelling third parties to provide information about the child. If there is a risk that the child/children might be removed from the country it can also place alerts through the Australian Federal Police.

If there is no current order in place, an application can be made and the police, once given a copy of this, can issue and alert on the child's name.
