Helena is a Lawyer in the Commercial Litigation Team.

Helena practices in commercial litigation and insolvency matters. Her commercial litigation experience includes acting for insurers in various claims, debt recovery actions for and against debtors and credit agencies, real and personal property disputes, contractual disputes, negligence claims, claims under the Trade Practices Act 1974 Copyright Act 1968, estate litigation, motor vehicle insurance claims and conducting general recovery actions. Her insolvency experience includes the winding up of corporations, acting for and against receivers, administrators, liquidators and trustees in bankruptcy.

Experience

• Acting for and against both corporate and individual creditors in relation to general recovery actions, including instituting and defending both winding up and bankruptcy proceedings.
• Advising the administrators and liquidators of companies with respect to their duties, powers and Responsibilities.
• Acting for liquidators, receivers and administrators in applications for approval or remuneration 
• Acting for liquidators in applications for release of liquidators and deregistration of companies.
• Acting for and against liquidators and trustees in bankruptcy and litigating voidable transaction claims under the Corporations Act and the Bankruptcy Act respectively.
• Acting for and against liquidators in actions against directors for insolvent trading.
• Litigating a breach of contract of employment and breach of confidentiality by employee;
• Acting for owner of a software in a claim for breach of copyright in the software by the defendant;
• Litigating a claim for misleading and deceptive conduct pursuant to sections of the Trade Practices Act.
• Acting for parties in relation to breach of contract cases and specific performance of contracts.
• Appearing as a solicitor-advocate in relation to civil litigation matters at both the Federal and State Courts.
